   An existing "no return policy" is in place for energy loss based death, but I'm not fully sure about the setting you mentioned.  For body parts or severely decomposed bodies, I normally increase the stat reduction, but I do allow the cure age spell to permanently replaced Constitution lost to ressurection.  (I know, I'm so generous to my players.)  On the other hand, I apply 1/4 the mana cost to the current ability in Will and 1/2 the mana cost in Energy Loss.  If this kills the caster, it is a life for a life.  They can replenish the Will through normal character gains.  This makes the rare few who can cast this spell quite reluctant to do so.  
     Most magics that have an "everlasting" effect, I will use some degree of cost from current Will on.  This DOES lower the caster's energy level.  I use it as a representation of the magical fatigue the spell has placed on the caster.  If certain things are done, however, I will overlook the cost.  In the case of resurrection, that may include seeking their killers (if that would be epic enough), finding rare components, or traveling to the upperworld, and retrieving their spirit.  
     Until you can get this spell to EL9, it can be truly murderous on the recipient.  The stat loss is rather severe, especially since it effects your Constitution.  One thing that might cause a "no returns" policy is the willingness of the target to return AND suffer the stat loss.  Another might be that they were resurrected before, and don't have enough Con to survive another one.
